YELO PRIVACY POLICY

The below published Privacy Policy is part of the binding Terms and Conditions Agreement between Desi Technologies, Inc., DBA as “Yelo,” and its Users, and is republished in its entirety herein. Please also review the greater T&C document for definitions or references to other numbered Clauses.

This Privacy Policy is part of the Agreement and governs how the Company protects the personal identifying information of Users and any person, including Users who seek Prearranged Rides from a driving User through the Yelo App or Network. “Personal identifying information” refers to information that, when used alone or with other relevant data or information, can identify an individual.

  1. Purpose.
    1. The Company is required to request and collect certain personal identifying information, as well as other information, of both Users prior to allowing access to the Yelo App or the Yelo Network. This Privacy Policy will help both Users understand what information the Company collects and how it protects such information.
    2. The Company may update this Privacy Policy from time to time as updates are made to the Yelo App and Yelo Network and privacy law changes. If the Company makes material updates to this Privacy Policy, it will notify all Users by electronic means. Users must agree to the most recent version of this Privacy Policy.
    3. The Company will protect the collected personal identifying information from both Users but Users are under an additional obligation to protect personal identifying information pertaining to Users (“User Personal Identifying Information”).
  2. No Users under the Age of Thirteen. In order to comply with the Children's Online Privacy Protection Act of 1998 (“COPPA”), the Company does not market its Yelo App or Yelo Network to any persons under the age of thirteen (13). The Company will not knowingly collect any personal identifying information from any person under the age of thirteen (13). If the Company determines that it has collected personal identifying information from a person under the age of thirteen then the Company will immediately delete such information and terminate access to the Yelo App and Yelo Network for the person who submitted such information to the Company.
  3. Information the Company Collects. The Company may use various means to collect information, including “cookies,” as described in this Section.
    1. Registration Information Provided by Users.
      1. When a User registers to use the Yelo App or the Yelo Network, the Company will collect certain information, including the registrant’s name, email address, phone number, date of birth, and photograph. The Company may also request information related to financial accounts or payment methods used by Users.
      2. The name, email address, phone number, date of birth, and payment or financial account information of User registrants will be included in User Personal Identifying Information.
      3. Driving Users will also be required to provide information related to the User’s driver’s license (including a photograph of the license), information related to the vehicle the driving User intends to use while using the Yelo App or Yelo Network, and information related to driving User’s vehicle insurance.
    2. Information Collected While Users Use the Yelo App and Yelo Network.
      1. When a User uses the Yelo App or Yelo Network, the Company will collect the information provided by Users, information related to use of the Yelo App or Yelo Network, information about electronic devices used by Users, ratings of other Users, feedback provided by Users, and communications from Users.
      2. The Company may collect information about Users from other sources like service providers (such as to verify the identity of a driving User).
      3. The Company will collect location information pertaining to Users when they use the Yelo App and Yelo Network and the Company may collect information from Users when the Yelo App is running in the background of their mobile phones or other electronic communications device.
      4. During Prearranged Rides, the Company will collect information related to the ride, including the date/time of the ride, the pickup location, the destination, the distance driven, the route taken by a driving User, payment information, and if the User used a promotional or referral code.
      5. The Company will also collect information related to electronic and mobile communications between Users during, prior to, and after Prearranged Rides.
    3. Information the Company Collects from Third Party Sources. Third parties provide the Company with information needed for certain of the Company’s business activities, including background check, fraud detection, investigations, and insurance. The Company obtains this information to ensure the safety of Users during Prearranged Rides and during their use of the Yelo App and Yelo Network.
  4. How the Company Uses Collected Information. The Company uses collected information as follows:
    1. Provide and Improve the Yelo App and Yelo Network. Information collected from Users is used to:
      1. verify the identity of Users;
      2. maintain accounts on the Yelo App and Yelo Network;
      3. electronically connect Users;
      4. transmit locations of the pickup location and destination of a Prearranged Ride;
      5. track Prearranged Rides;
      6. provide promotions to Users;
      7. deliver communications from/to the Company to/from Users;
      8. collect feedback and ratings;
      9. calculate fares and process payments;
      10. perform testing and debugging;
      11. monitor the performance, security, and processing of the Yelo App and Yelo Network; and
      12. develop new products and features of the Yelo App and Yelo Network.
    2. Maintain Security and Safety. To maintain the security of the Yelo App and Yelo Network, and to ensure the safety of Users, the Company uses collected information to:
      1. authenticate and verify Users, and to prevent fraudulent registrations of Users;
      2. encourage safe Prearranged Rides and Transactions;
      3. verify that driving User’s vehicles meet safety, legal, and regulatory requirements;
      4. verify that Users are covered by proper insurance;
      5. investigate alleged violations of the Company’s policies, requirements, terms of use, and guidelines;
      6. investigate accidents and any related insurance claims; and
      7. ensure that Users who violate the Company’s policies, requirements, terms of use, and guidelines are terminated from using the Yelo App and Yelo Network.
    3. Provide Customer Support. The Company may use collected information to assist Users to provide proper levels of customer support.
    4. Responding to Legal Proceedings and Requirements. The Company may be required to provide collected information to law enforcement or regulatory bodies pursuant to court orders, government investigations, or subpoenas.
  5. How the Company Shares Collected Information. The Company will not sell any collected information, including collected personal identifying information, to any third parties.
    1. Sharing Between Users.
      1. User Information Shared with Users.
        1. Pursuant to requests and fulfillment of Prearranged Rides and Transactions, the Company is required to share certain information pertaining to a User with Users in order to facilitate the transaction or Prearranged Ride. Such information will include the pickup location, the User’s destination, and a rating of the User, the location of a service providing User where services are offered, or the location where a purchasing User may pick up merchandise sold through the App.
        2. Such information may include certain User Personal Identifying Information, namely, the User’s name and telephone number. Users may optionally include a photograph when creating their account to use the Yelo App and Yelo Network and such photograph may also be shared with a driving User.
        3. Feedback and ratings submitted by Users may be shared with Users upon the completion of Transactions and Prearranged Rides but the identity of the submitting User will be redacted.
      2. Driving User Information Shared with Users. After a driving User accepts a requested for a Prearranged Ride, the Company will share with the requesting User the driving User’s name, profile photo, rating, real-time location, and the make, model, color, and license plate of the driving User’s vehicle.
      3. Lost Items. In the event a User believes that the User has lost a personal item during a Prearranged Ride, the User should contact the Company through the Yelo App with information related to a description of the lost item. The Company will then contact the relevant driving User and attempt to locate the lost item.
    2. Sharing with Third Party Service Providers. The Company will be required to share certain collected information to third parties for the following purposes:
      1. to process driving User registrations and to verify the identities of Users;
      2. to provide the Yelo App and Yelo Network;
      3. to facilitate Prearranged Rides;
      4. to process financial transactions;
      5. to process any insurance claims;
      6. to detect fraud, unsafe behavior during Transactions or Prearranged Rides, or possible violations of the Company’s policies, requirements, terms of use, and guidelines;
      7. to provide access to any requested emergency services;
      8. to provide customer service; and
      9. to provide research and marketing activities.
    3. Legal Reasons.
      1. The Company may be required to share collected information and personal identifying information, including User Personal Identifying Information:
        1. with law enforcement or regulatory bodies pursuant to court orders, government investigations, or subpoenas, or
        2. so that Company can protect or defend, or investigate alleged violations of, the Company’s policies, requirements, terms of use, and guidelines.
      2. The Company may also share collected information in order to comply with required permits or licenses; to enforce the Company’s policies, requirements, terms of use, and guidelines; and to exercise or defend the Company’s legal rights or the rights of Users, Users, or other third parties.
  6. Links to Third-Party Apps or Websites. The Yelo App may contain links or references to third-party websites, products, or services. Those third parties may have privacy policies that differ from the Company’s and Company is not responsible for those third parties and their websites, products or services. The Company suggests Users contact those third parties directly with questions about their privacy policies.
  7. How the Company Stores and Protects Collected Information.
    1. The Company will retain collected information for as long as necessary to provide Users access to the Yelo App and Yelo Network. The Company will retain collected information, including personal identifying information, submitted by Users for so long as the Users maintain an account to use the Yelo App and Yelo Network. The Company will retain transactional information related to Prearranged Rides for so long as required to ensure that the Company can perform its business functions, its tax obligations, its legal obligations, its customer service, and to ensure compliance with and enforce its policies, requirements, terms of use, and guidelines. The Company will, however, delete collected personal identifying information if requested by a User, although the Company will be required to delete the account of the requesting User.
    2. The Company takes reasonable and appropriate information security measures to protect collected information. No security measure is completely effective, and the Company makes no warranty or guarantee against unauthorized access to its information technology systems.
  8. Rights and Choices Regarding Collected Information.
    1. Unless as described in the limited situations set forth in this Privacy Policy, the Company will not disclose any User Personal Identifying Information without the express written consent of the User to which such User Personal Identifying Information relates.
    2. Users may login to their accounts they created to use the Yelo App and Yelo Network to access and determine the information collected and stored by the Company. Users may delete their collected personal identifying information, but the Company may be unable to provide access to the Yelo App and Yelo Network upon deletion of certain collected personal identifying information. Users seeking to delete such information may be required to delete their accounts and cease to use the Yelo App and Yelo Network. In some instances, the Company may be unable to delete a User’s account, such as if the account is under investigation due to alleged safety violations or fraud. The Company may also be required to retain certain personal identifying information for legitimate business purposes (such as resolving insurance claims) or to comply with legal or regulatory obligations upon account deletion.
